*Customers who train in image, style or any other image related course, or any other educational company of ANY kind, or run companies that train in any image related field are strictly prohibited from purchasing FSI courses. No refunds are given if it is found that this policy has been violated after purchase. 

AGREEMENT

Fashion Stylist Institute owns and operates this Website portal assigned as fashionstylistinstitute or my.fashionstylistinstitute.com. This document governs your relationship with Fashion Stylist Institute. Access to and use of this Website and the products and services available through this Website (collectively, the "Services") are subject to the following terms, conditions and notices (the "Agreement"). By using the Services, you are agreeing to all of the Agreement.

(a) Our Contract With You

This is a legal document. Read it carefully. Show it to an attorney.

When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order: this email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us will not be formed until we send you confirmation by e-mail that the goods (or course/s) which you ordered have been dispatched to you. Only those goods listed in the confirmation e-mail sent at the time of dispatch will be included in the contract formed (this Agreement).

(b) Pricing and Availability

Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.

(c) Payment 

Upon receiving your order we carry out a standard authorization check on your payment card to ensure there are sufficient funds to fulfil the transaction. Your card will be debited upon authorization being received. The monies received upon the debiting of your card shall be treated as a deposit against the value of the goods you wish to purchase. Once the goods have been dispatched and you have been sent a confirmation email the monies paid as a deposit shall be used as consideration for the value of goods you have purchased as listed in the confirmation email. Enrolling students MUST be the purchaser for security reasons. Students must make their own arrangements outside of FSI to get reimbursed or credited from their employer. We do NOT provide this service. Email us if you have questions.

(d) Refunds

FSI does not refund the course payments since all material is accessible and obtainable online immediately. Open courses are considered to be accessed.

NON COMPLETION - FSI holds no responsibility for students who abandon or do not finish their course on time. Effective time management will secure your completion within the generous time-frame allotted for you to finish the course.  FSI is NOT approved to extend the time limit for students beyond the stated time frame of the course. We do NOT extend and students are responsible for completing their course work within that time period. The published time frame is ample and sufficient time to complete your course. Please plan your study plan accordingly. We can make NO exceptions to this policy. Note that upon completion of your course all materials and training modules complete and cannot be accessed again.

NON ATTENDANCE - students purchasing courses cannot HOLD them indefinitely. A course will expire at the end of designated course time frame. If no attendance is made FSI does NOT open the course again. The course is considered abandoned and the purchase expires. FSI does NOT refund for abandoned (non attendance) courses. FSI also does not extend the expiration limit for non-attended courses. FSI is not authorized to and does not extend set course time limits to students who do not finish their course in the generous time frame allotted. Changing your mind, lack of technical skills, disinterest, illness, or any other lack of attendance excuse is not a valid refund reason. If you have uncertainty about taking an online course you must contact us first. We do not refund the course payments since materials are accessible and obtainable online immediately. Enrollment is considered to be accessed.

(e) Disclaimer of Liability

The material displayed on this Website is provided without any guarantees, conditions or warranties as to its accuracy. Unless expressly stated to the contrary to the fullest extent permitted by law Fashion Stylist Institute and its suppliers, content providers and advertisers hereby expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity and shall not be liable for any damages whatsoever, including but without limitation to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, damage to goodwill or reputation, or the cost of procurement of substitute goods and services, arising out of or related to the use, inability to use, performance or failures of this Website or the Linked Sites and any materials posted thereon, irrespective of whether such damages were foreseeable or arise in contract, tort, equity, restitution, by statute, at common law or otherwise. This does not affect Fashion Stylist Institute's liability for death or personal injury arising from its negligence, fraudulent misrepresentation, misrepresentation as to a fundamental matter or any other liability which cannot be excluded or limited under applicable law.

(f) Linking to this Website

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You must not establish a link from any website that is not owned by you. This Website must not be framed on any other site, nor may you create a link to any part of this Website other than the home page. We reserve the right to withdraw linking permission without notice.

(g) Disclaimer as to ownership of trade marks, images of personalities and third party copyright:

Except where expressly stated to the contrary all persons (including their names and images), third party trade marks and content, services and/or locations featured on this Website are in no way associated, linked or affiliated with Fashion Stylist Institute and you should not rely on the existence of such a connection or affiliation. Any trade marks/names featured on this Website are owned by the respective trade mark owners. Where a trade mark or brand name is referred to it is used solely to describe or identify the products and services and is in no way an assertion that such products or services are endorsed by or connected to Fashion Stylist Institute.

(h) Indemnity

You agree to indemnify, defend and hold harmless Fashion Stylist Institute, its directors, officers, employees, consultants, agents, and affiliates, from any and all third party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from your use of this Website or your breach of the Agreement.

(i) Variation

Fashion Stylist Institute shall have the right in its absolute discretion at any time and without notice to amend, remove or vary any page of this Website (other than, of course, this Agreement with you).

(j) Invalidity

If any part of this Agreement is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of the Agreement will not be affected; all other clauses remaining in full force and effect. So far as possible where any clause/sub-clause or part of a clause/sub-clause can be severed to render the remaining part valid, the clause shall be interpreted accordingly. Alternatively, you agree that the clause shall be rectified and interpreted in such a way that closely resembles the original meaning of the clause /sub-clause as is permitted by law.

(k) Mandatory Binding Arbitration

In case of a dispute between the Parties arising out of or relating to this Agreement, the Parties shall first attempt to resolve the dispute personally and in good faith. If these personal resolution attempts fail, the Parties shall then submit the dispute to mandatory binding arbitration. The Parties understand and agree that binding arbitration is the sole method of dispute resolution available to them with the exception of Intellectual property claims by FSI (see below Exception to mandatory binding arbitration). The Parties waive any rights they may have to a jury trial in regard to arbitral claims. The arbitration shall be conducted by a single arbitrator in the County of Sacramento, California pursuant to the commercial arbitration rules of the American Arbitration Association then in force and effect, and such arbitrator shall have no authority to add Parties, certify a class, award punitive damages, or vary the  provisions of this Agreement. Each Party shall pay their own costs and fees of arbitration. The decision of the arbitrator is final, non-appealable, and fully enforceable as a judgement in a court of law with jurisdiction.

Exception to mandatory binding arbitration: Intellectual property claims by FSI will not be subject to arbitration and may, as an exception to the mandatory binding arbitration required by the Agreement, be litigated.

Terms of Use

Access to this Website is granted upon execution of this Agreement. FSI will not be liable if for any reason this Website is unavailable at any time or for any period. From time to time, we may restrict access to some parts or all of this Website. 

FSI grants you, the learner, a limited, non-exclusive, non-transferable right to access and view the course and associated content for which you have paid all required fees, solely for your personal, non-commercial, educational purposes while in the course. All other uses are expressly prohibited. You may not reproduce, redistribute, transmit, assign, sell, broadcast, rent, share, lend, modify, adapt, edit, create derivative works of, sub-license, or otherwise transfer or use any course, parts of course, including images, text, audio and its associated components, design, intellectual property, trademarked methods, copyrighted tools or materials.

Note that it is against our policy to re-supply forms, documents, manuals or material once a graduate has downloaded to their device. FSI assumes no responsibility or obligation to supply additional copies of materials already supplied to a student while in their course. This means that if a graduate student has a computer malfunction on their end, FSI is NOT obligated, and will not, supply duplications of material to a student outside of the closed student course. Backing up your devices and keeping your devices in order is your responsibility, not ours.

PLAGIARISM - students who screen grab copyrighted images, illustrations, photos and material from this site will be immediately suspended, removed from our school and accounts closed. Students submitting assignments using copyrighted material without the permission of the maker or author will also be suspended. This is an ethical and legal violation of international copyright laws and FSI implements zero tolerance for these violations. Plagiarism of our copyright materials and the use of same outside of this portal (for example in a blog, on your website, in your newsletter, in marketing materials, sales tools or otherwise) is considered an ethics violation and will result in:

  1. a) immediate cancellation of your account with FSI
  2. b) withdrawal of your name from any of our courses
  3. c) expulsion without warning from FSI and its affiliate training schools
  4. d) immediate removal of your graduate directory listing on our directory site
  5. e) immediate filing of an AICI ethics violation report (which can later deny you any membership to this organization)

Plagiarism of any sort is not tolerated in our online community or in the image field. Do not risk your entire career because you were not able to create your own content. If you are struggling with an ethics issue please consult someone before you act inappropriately.

This Website may contain links to other websites (the "Linked Sites"), which are not operated by Fashion Stylist Institute and has no control over the Linked Sites and accepts no responsibility for them or for any loss or damage that may arise from your use of them. Your use of the Linked Sites will be subject to the terms of use and service contained within each such site.

What’s a cookie? This website wants to use cookies that do not contain any information that identifies you but saves our links on your device and remembers you so you can visit us again. We don’t grab your email unless you provide it when you enroll. A cookie also enables students to use their credentials when they sign in to work in their course. A cookie is not a virus. It’s a piece of code that identifies your use only and that recognizes you when you return here. We don't do anything with these cookies, they are not even edible. Cookie is also the name of a character on Empire but not related to our cookies. You can still browse even without accepting this policy, we don't really care. Just saying!

Privacy Policy

Our privacy policy, which sets out how we will use your information, can be found at [Privacy Policy Link]. By using this Website, you consent to the processing described therein and warrant that all data provided by you is accurate.

*Prohibitions

If you own or manage a training business or online website offering education courses then you are prohibited from purchasing our courses. Due to the copyright nature of our online portals and content we do not allow users to join us who are intent on copying, borrowing, sampling, discovering or otherwise using the student portal, course content, course materials and other copyrighted formats to benefit their own institution. If a current student or graduate alumni is found to be in violation of this policy they will be removed from our portal and graduate sites and their certification will be nullified. On a case-by-case basis we reserve the right to notify AICI of an ethics violation if this policy is abused. Our courses are strictly for consultants and not for trainers. 

You must not misuse this Website. You will not: commit or encourage a criminal offense; transmit or distribute a virus, trojan, worm, logic bomb, social post, or any other material which is malicious, technologically harmful, in breach of confidence or in any way offensive or obscene; hack into any aspect of the Service; corrupt data; cause annoyance to other users; infringe upon the rights of any other person's proprietary rights; send any unsolicited advertising or promotional material, commonly referred to as "spam"; or attempt to affect the performance or functionality of any computer facilities of or accessed through this Website. Breaching this provision would constitute a criminal offense and Fashion Stylist Institute will report any such breach to the relevant law enforcement authorities and disclose your identity to them.

We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of this Website or to your downloading of any material posted on it, or on any website linked to it.

Trainers, those who award certificates or education units, learning centers and Training Schools, foreign or otherwise, are not accepted as students in FSI. Contact us with questions prior to purchase.

Intellectual Property, Software and Content

The intellectual property rights in all software and content (including photographic images) made available to you on or through this Website remains the property of Fashion Stylist Institute or its licensors and are protected by copyright laws and treaties around the world. All such rights are reserved by Fashion Stylist Institute and its licensors. You may store, print and display the content supplied with permission by Fashion Stylist Institute solely for your own personal use. You are not permitted to screen grab, copy text, publish, manipulate, distribute or otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which appears on this Website nor may you use any such content in connection with any business or commercial enterprise.

Terms of Sale

By placing an order you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price.

Dispatch times may vary according to availability and subject to any delays resulting from postal delays or force majeure for which we will not be responsible. 

In order to contract with Fashion Stylist Institute you must be age of majority in your state or country and possess a valid credit or debit card issued by a bank acceptable to us. Fashion Stylist Institute retains the right to refuse any request made by you. If your order is accepted we will inform you by email and we will confirm the identity of the party which you have contracted with. This will usually be Fashion Stylist Institute or may in some cases be a third party. Where a contract is made with a third party Fashion Stylist Institute is not acting as either agent or principal and the contract is made between yourself and that third party and will be subject to the terms of sale which they supply you. When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorized user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods. The cost of foreign products and services may fluctuate. All prices advertised are subject to such changes.

Bonus courses: FSI offers bonus courses that hold no retail value but are included with purchase of certain courses. These bonus courses cannot be "refunded" for any monetary value.

Usage - All courses are open to the student for the time limit designated on the course description (time variants are publicly posted) OR until the entire course is completed whichever comes first. The course will close upon completion and material will not be accessible. 

Graduates of FSI have access to news, forums, resources so long as they are active in the portal. Course does close upon completion. If you are not active your portal will close automatically after one year of inactivity. We do charge a processing fee of $19.99 if you request your account to be reopened.

Graduate directory listings are subject to approval by FSI staff. Changes requested by a graduate to their listing will incur a small fee. See website for details.

You may not amend or waive any provision of this Agreement unless in writing and signed by both parties.

This Agreement shall be governed by and interpreted in accordance with the internal laws of the State of California without regard to the conflicts of laws and principles thereof.

This Agreement represents the entire agreement between us and you, the Parties, and shall supersede all prior agreements and communications of the parties, oral or written. Each Party irrevocably submits to the exclusive jurisdiction and venue of the federal and state courts located in the County of Sacramento, California.
